Standards of Fill for Wine and Distilled Spirits
Published Date: 1/10/2025
Rule
Summary
Starting January 10, 2025, new rules let wine and spirits makers use 13 new container sizes for wine and 15 for spirits, making it easier to sell and ship their products. The rules also simplify things by treating canned and non-canned spirits the same. This means more choices for buyers and smoother business for producers, with no extra costs expected.
Analyzed Economic Effects
4 provisions identified: 3 benefits, 0 costs, 1 mixed.
New authorized wine container sizes
Starting January 10, 2025, TTB authorizes 13 new standards of fill for wine. The newly authorized wine sizes are: 180 mL, 300 mL, 330 mL, 360 mL, 473 mL (16 oz), 550 mL, 569 mL (19.2 oz), 600 mL, 620 mL, 700 mL, 720 mL, and 1.8 L and 2.25 L. TTB says these additions give producers more packaging flexibility and provide consumers broader purchasing options.
New distilled spirits sizes and harmonization
Starting January 10, 2025, TTB authorizes 15 new standards of fill for distilled spirits and removes the separate size rules for cans versus other containers. The newly authorized distilled spirits sizes are: 187 mL, 250 mL, 331 mL, 350 mL, 355 mL, 475 mL, 500 mL, 570 mL, 700 mL, 710 mL, 945 mL, and 1.5 L, 2 L, 3 L, and 3.75 L; all these sizes are approved for both cans and containers other than cans. TTB says this change promotes flexibility and consistency for producers and importers.
No new compliance burdens for businesses
TTB certified this final rule will not have a significant economic impact on a substantial number of small entities and does not add new reporting or recordkeeping requirements. The rule relieves a restriction by allowing new container sizes but does not impose additional administrative obligations, and it is effective January 10, 2025.
Standards retained, not eliminated
TTB decided not to eliminate standards of fill entirely and instead added specific new sizes while keeping the standards in place. The agency concluded that adding specific sizes balances increased flexibility with reducing the risk of consumer confusion, effective January 10, 2025.
