Federal Funds Block for Vaccine Mandates

The President ordered that, as of February 14, 2025, discretionary Federal funds should not be used to support any elementary school, secondary school, local or State educational agency, educational service agency, or institution of higher education that requires students to have a COVID-19 vaccination to attend in-person. This policy ties federal funding to compliance with the no-mandate rule.

90-Day Plan to Identify and Rescind Funds

Within 90 days of February 14, 2025, the Secretary of Education, with HHS consultation, must give the President a plan to end coercive COVID-19 school mandates. The plan must include (i) a list of discretionary Federal grants and contracts to elementary and secondary schools, educational agencies, and institutions of higher education that are non-compliant with the guidance, and (ii) each department or agency's process for preventing and rescinding Federal funds from non-compliant entities, to the maximum extent consistent with law.

Guidance on Parental Rights and Accommodations

The Secretary of Education must issue guidelines as soon as practicable to elementary and secondary schools, local and State educational agencies, and institutions of higher education about legal obligations related to parental authority, religious freedom, disability accommodations, and equal protection tied to COVID-19 vaccine mandates. The guidance is intended to clarify schools' obligations and students' and parents' rights.
