Members of TdA Face Apprehension
The President proclaimed on March 14, 2025 that Venezuelan citizens 14 years of age or older who are members of Tren de Aragua (TdA), are present in the United States, and are not naturalized or lawful permanent residents are liable to be apprehended, detained, removed, and are not permitted residence in the United States. The proclamation also declares such members ineligible for the benefits of 50 U.S.C. 22 and subject to summary apprehension wherever found within U.S. jurisdiction.
Seizure and Forfeiture of TdA Property
The proclamation directs that all property in the possession of, or traceable to, an Alien Enemy (as defined for Tren de Aragua members) which is used or intended to be used to perpetrate hostile activity or irregular warfare shall be subject to seizure and forfeiture. Evidence of such hostile activity and irregular warfare is likewise subject to seizure and forfeiture under the proclaimed regulations.
