Notice

Summary

NYSE Texas is updating its fee schedule for connecting to outside systems and data feeds. This change affects anyone using their services to access third-party data, adjusting who can charge fees and how much. The new rules kicked in right away on April 16, 2025, so users should check the updated costs and connections now.

Analyzed Economic Effects

4 provisions identified: 1 benefits, 2 costs, 1 mixed.

Monthly data‑feed fees changed

The Exchange changed monthly recurring connectivity fees for many Third Party Data Feeds effective April 16, 2025. Examples: Blue Ocean ATS (BOATS) $750/month; Cboe CFE Futures $1,500/month; Long Term Stock Exchange $2,600/month; MEMX Equities $2,000/month; MEMX Options $2,000/month; Small Exchange $1,000/month; combined Cboe Canada $2,000/month; Nasdaq Stock Market (combined with ISE) $3,000/month; TMX Group (combined with Montreal Exchange) $2,500/month; and multiple MIAX feeds at $2,600/month each.

Connectivity partners can pass through fees

The Exchange added the phrase "and their partners" to clarify that third‑party data providers and their connectivity partners may charge redistribution fees, and the Exchange will pass those fees through to Users on invoices. The filing specifically notes the Exchange expects a BOATS connectivity partner will charge a redistribution fee that will be passed through to the User. This change took effect April 16, 2025.

New third‑party systems added

If you use NYSE Texas colocation services, the Exchange added these Third Party Systems at the Mahwah data center: Blue Ocean ATS (BOATS), Canadian Imperial Bank of Commerce (CIBC), Long Term Stock Exchange, MEMX, Pragma, and Small Exchange. This change took effect on April 16, 2025 and simply makes those systems available for Users to contract with and connect to via existing bandwidth options.

Changes effective immediately (April 16, 2025)

The proposed fee and connectivity changes became effective immediately on April 16, 2025. If you use NYSE Texas colocation or feed connectivity, you should check the updated Connectivity Fee Schedule now to see any new fees or combinations that apply to your services.
