New Mandate: Tell Feds Before Picking Hospitals During Strikes

Published Date: 9/17/2025

Notice

Summary

If health care workers plan to strike or picket, they must tell the Federal Mediation and Conciliation Service (FMCS) first using a special form. This rule helps keep everyone informed and ready, making sure strikes don’t catch health care places off guard. The FMCS is asking for public feedback before finalizing this form, which could affect how quickly strikes are reported and handled.

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Mandatory FMCS Strike Notification Form

If you are a health care worker represented by a labor organization, your union must notify the Federal Mediation and Conciliation Service (FMCS) using a special “Notification of intention to strike or picket at any health care institution” form before engaging in any strike, picketing, or other concerted refusal to work at a health care institution.

Advance Notice Protects Health Facilities

The notification rule is intended to keep health care institutions informed and prepared by ensuring FMCS receives advance notice of planned strikes or picketing at any health care institution so those facilities are less likely to be caught off guard.
