That means entities will not face DOJ enforcement for covered actions that occurred from January 19, 2025 through the issuance date and the extension period.

Attorney General Directed to Block State or Private Enforcement

The order directs the Attorney General to use available authority to preserve the Executive Branch's exclusive power to enforce the Act and to prevent attempted enforcement by States or private parties. The Attorney General must act to defend against state or private enforcement efforts.

Attorney General to Issue No‑Liability Letters and Guidance

The Attorney General is ordered to issue written guidance and send letters to each provider stating there has been no violation and there is no liability for conduct during the extension period and from the Act's effective date until the date of this order. Providers will receive formal statements of no-liability covering those dates.
