EPA states this tolerance action does not impose an enforceable duty on the private sector, does not contain an unfunded mandate of $100 million or more, and does not create new information-collection burdens under the Paperwork Reduction Act. The Regulatory Flexibility Act does not apply to this petition-based tolerance action.

Import tolerance aligned with Codex MRL

The petition established an import tolerance for fluopyram in or on mango at 1.0 ppm and EPA notes there are no U.S. registrations for this use. EPA also notes the Codex maximum residue limit (MRL) for fluopyram on mango is 1 ppm, the same level established by this rule.
