Fee for Aliens Removed in Absentia
If you were ordered removed in absentia and are later arrested by U.S. Immigration and Customs Enforcement (ICE), DHS will charge you a $5,130 enforcement fee starting December 1, 2025 for Fiscal Year 2026. HR-1 (Public Law 119-21) says no waivers are available for this fee, though the fee does not apply if the removal order is rescinded under INA section 240(b)(5)(C).
Fee for Inadmissible Aliens Apprehended
If you are found inadmissible under INA section 212 and are apprehended by DHS between ports of entry, DHS will charge you a $5,130 apprehension fee starting December 1, 2025 for Fiscal Year 2026. This fee amount is the FY 2026 inflation-adjusted level set under HR-1 (Public Law 119-21).
