Landowners May Face Eminent Domain
If you own land in the project area in West Virginia or Virginia, the pipeline company may contact you to buy an easement but you are not required to agree. If FERC approves the project, the Natural Gas Act conveys eminent domain authority to the company, and if you and the company do not reach an easement agreement the company could initiate condemnation in court with compensation determined by a judge under state law.
Construction Will Disturb and Permanently Use Land
The project would disturb about 43.3 acres of land during construction in parts of West Virginia and Virginia and Mountain Valley would permanently maintain about 21.3 acres for the project's facilities while restoring the rest.
