Instructor Exempted From CDL Requirement

FMCSA granted an exemption allowing Mr. William Cole to provide entry-level driver theory training for the hazardous materials (H) endorsement without possessing or having previously held a commercial driver’s license (CDL). The exemption is limited to classroom (theory) training for the H curriculum (Appendix E of Part 380) and is effective December 2, 2025 through December 2, 2030.

Entry-Level Drivers May Be Trained By Non-CDL Instructor

Entry-level drivers seeking the hazardous materials (H) endorsement may receive the required ELDT classroom (theory) instruction from Mr. William Cole even though he does not hold and has not previously held a CDL. This permission applies only to theory instruction (not behind-the-wheel training) during the exemption period (December 2, 2025 to December 2, 2030).

Federal Exemption Preempts Conflicting State Rules

While the exemption is in effect (December 2, 2025 through December 2, 2030), no State may enforce any law or regulation applicable to interstate commerce that conflicts with this exemption for the person operating under it. States may, but are not required to, adopt the same exemption for intrastate operations.
