Commerce Opens Door for Antidumping Duty Review Requests

The Department of Commerce will pick which companies to review based on import data, so get your paperwork in quickly! Failure to Request Triggers Duty Assessment
If Commerce does not receive a request for review by the last day of January 2026 for an order listed in this notice, Commerce will instruct U.S. Customs and Border Protection to assess antidumping or countervailing duties on those entries at a rate equal to the cash deposit required at entry and to continue collecting that cash deposit.
Deadline to Request Administrative Review
If you are an interested party (importer, exporter, or producer) you may request an administrative review for the listed antidumping (AD) and countervailing duty (CVD) orders. Requests must be received not later than the last day of January 2026 for the listed orders and periods (for example, periods like 1/1/25–12/31/25 are listed for many orders).
Particular Market Situation (PMS) Submission Timing
If you want to submit a particular market situation (PMS) allegation under section 773(e) of the Tariff Act, you must file the PMS allegation and supporting factual information no later than 20 days after submission of initial Section D responses. If Commerce finds a PMS exists, it will modify dumping calculations accordingly.
Non‑Market‑Economy (NME) Entity Review Rule
Commerce no longer treats the non-market-economy (NME) entity as an exporter conditionally subject to review; the NME entity will not be under review unless Commerce specifically receives a request or self-initiates a review. If an individual exporter in an NME proceeding does not qualify for a separate rate and the NME entity was not under review, Commerce will treat that exporter as part of the NME entity and the NME entity rate will not change as a result of that review.
Respondent Selection Uses CBP Import Data
If Commerce limits the number of respondents, it will select them using U.S. Customs and Border Protection (CBP) import data for the period of review. Commerce will release that CBP data under an administrative protective order within five days of the initiation notice and will make a respondent-selection decision within 35 days of the initiation notice; parties have five days after the CBP data are placed on the record to comment.
90-Day Withdrawal Window for Review Requests
A party that requests an administrative review may withdraw that request within 90 days of the publication date of the initiation notice; Commerce may extend the 90-day withdrawal period on a case-by-case basis.
Annual Inquiry Service List Update Requirement
Commerce will update annual inquiry service lists for the listed proceedings and interested parties have 30 days after the date of this notice to submit new or amended entries of appearance; Commerce will finalize the lists five business days after that 30‑day window. Petitioners and foreign governments that have submitted an entry once will be automatically added in subsequent years, and law firms representing multiple parties are asked to designate a lead attorney.
