Possible Automatic Incorporation Rule

Under section 104(b)(4)(B) of the CPSIA, if the Commission does not notify ASTM within 90 days that it rejects the revised voluntary standard, the revised voluntary standard (ASTM F1004-25) will be considered a consumer product safety standard under section 9 and become effective 180 days after the Commission received notice of the revision (or a later date specified by the Commission).

Public Comment Deadline: Feb 10, 2026

The Consumer Product Safety Commission is asking for public comment on the revised voluntary standard ASTM F1004-25. Comments must be received by February 10, 2026, and should be submitted to Docket No. CPSC-2019-0014 via regulations.gov or the methods listed in the notice.

CPSC Assessing ASTM F1004-25 Revision

ASTM notified CPSC on January 20, 2026, that it approved and published ASTM F1004-25. The Commission is assessing whether the revisions in ASTM F1004-25 improve the safety of gates and enclosures subject to 16 CFR part 1239.

Read-only copies of the currently incorporated standard (ASTM F1004-22) and the revised standard (ASTM F1004-25), including red-lined changes, are available at no cost on ASTM's website (https://www.astm.org/CPSC.htm and https://www.astm.org/READINGLIBRARY/). Parties may also purchase copies from ASTM or inspect copies at CPSC's Office of the Secretary in Bethesda, MD.
