Agency Information Collection Activities; Approval of a New Information Collection Request: Restoring Integrity to the Issuance of Non-Domiciled Commercial Drivers Licenses (CDL)

Published Date: 1/30/2026

Notice

Summary

The FMCSA is making sure only the right people get commercial driver’s licenses (CDLs) by tightening rules for those living outside the U.S. States that issue these licenses will collect new info to keep things honest. This update needs approval by March 2, 2026, and won’t cost much time—just about 15 minutes per application.

Analyzed Economic Effects

3 provisions identified: 0 benefits, 3 costs, 0 mixed.

States must keep CDL application records

If you apply for a non-domiciled commercial learner's permit (CLP) or commercial driver's license (CDL), the State Driver Licensing Agency (SDLA) will keep the documents you provide for at least two years from the date of issuing, renewing, transferring, or upgrading the CLP/CDL.

States must produce records within 48 hours

States that issue non-domiciled CLPs and CDLs must produce copies of the application documents to FMCSA within 48 hours of a request, enabling FMCSA to review licensing records quickly.

New ID and SAVE records; small time burden

The information collection requires SDLAs to copy the two identification documents used in the application and a copy of the required SAVE (Systematic Alien Verification for Entitlements) query; FMCSA estimates about 15 minutes per response, 51 respondents, and 1,500 total annual burden hours. The emergency approval for this collection expires on February 28, 2026, and FMCSA seeks a full three-year approval.
