No Dumping Found in India's Violet Pigment Exports Review

Summary

The U.S. Department of Commerce found that Western Chemical Industries from India didn’t sell Carbazole Violet Pigment 23 at unfairly low prices during Dec 2023–Nov 2024. They’re also stopping the review for Meghmani Pigments for now. This means some companies might see changes in duties soon, and everyone involved can share their thoughts before final decisions.

Zero or de minimis margins mean no duties

Commerce will instruct U.S. Customs and Border Protection to liquidate entries covered by this review without regard to antidumping duties if a respondent's weighted-average dumping margin is zero or de minimis (i.e., less than 0.5 percent) in the final results. The POR covered is December 1, 2023 through November 30, 2024.

Cash deposit rules after final results

For shipments of CVP-23 from India entered on or after the date of publication of the final results, the cash deposit rate for companies under review will be the rate established in the final results (and if that rate is zero or de minimis, no cash deposit will be required). Company-specific prior rates remain in effect for previously reviewed firms, and the all-others cash deposit rate will remain 27.48 percent for other manufacturers or exporters.

Automatic assessment practice for unreviewed entries

Commerce states that, under its automatic assessment practice, entries of subject merchandise produced by a respondent and entered during the POR for which the respondent did not know the merchandise was destined to the United States will be liquidated at the all-others rate of 27.48 percent if there is no rate for intermediate companies involved in the transaction.

Zero dumping margin found for Western

Commerce preliminarily found that Western Chemical Industries P Limited had a weighted-average dumping margin of 0.00 percent for sales of Carbazole Violet Pigment 23 during the period December 1, 2023 through November 30, 2024. If the final result remains 0.00 percent, entries covered by this review for Western Chemical may be liquidated without regard to antidumping duties for that period.

Importer-specific ad valorem assessments

If a respondent's weighted-average dumping margin is not zero or not de minimis in the final results, Commerce will calculate importer-specific ad valorem antidumping duty assessment rates based on the ratio of total dumping calculated for each importer's examined sales to the total entered value of those same sales, and CBP will assess duties accordingly for entries covered by this review.

Review rescinded for Meghmani Pigments

Commerce is rescinding the administrative review with respect to Meghmani Pigments because Meghmani timely withdrew its request for review on January 22, 2025. The review will not proceed for Meghmani for the period December 1, 2023 through November 30, 2024.
