US Hits Chinese Anode Material with Countervailing Duties for Fair Trade

Very High Duties on Chinese Anode Imports
Commerce found countervailable subsidies and set ad valorem countervailing duty rates of 66.86% for Panasonic Global Procurement China Co., Ltd. (and All Others) and 66.82% for BTR New Material Group Co., Ltd., Shanghai Shaosheng Knitted Sweat, and Huzhou Kaijin for the period January 1, 2023 through December 31, 2023. These duties apply to imports of the covered active anode material from China and are applicable beginning February 17, 2026.
Cash Deposits and Suspension Rules for Imports
Commerce instructed U.S. Customs and Border Protection (CBP) to collect cash deposits and suspend liquidation of entries of the subject merchandise entered or withdrawn for consumption on or after May 28, 2025. Commerce directed CBP to discontinue suspension for entries on or after September 26, 2025, but to continue suspension of liquidation of entries on or before September 25, 2026. If the U.S. International Trade Commission (ITC) issues a final affirmative injury determination, Commerce will issue a countervailing duty order and require cash deposits for entries entered or withdrawn for consumption on or after the effective date of the suspension of liquidation; if the ITC finds no injury, deposits will be refunded.
Which Anode Materials Are Covered
The rule covers active anode material that is an anode-grade graphite material with at least 90% carbon by weight, an energy density of 330 milliamp hours per gram or greater, and a degree of graphitization of 80 percent or greater, whether synthetic, natural, or blended and in powder, dry, liquid, or block form. The scope lists HTSUS subheadings 2504.10.5000, 3801.10.5010, 3801.10.5090 (and possibly 2504.10.1000 and 3801.90.00) and explicitly excludes active anode material already incorporated into imported lithium-ion battery products, electric vehicles, hybrid vehicles, cell phones, or battery energy storage systems.
