Conforming Amendments Delayed Indefinitely

As of April 6, 2026, the effective date for conforming amendments published April 18, 2024 (89 FR 28218) that were scheduled to take effect April 8, 2026 is delayed indefinitely while a court reviews the rule. The judicial stay issued April 11, 2025 means the temporary sections (e.g., Sec. 56.5001T, 56.5005T, 57.5001T, 57.5005T) will not be redesignated or enforced until the court-ordered stay is lifted.

Existing Miner Safety Standards Remain Enforced

MSHA will continue enforcing the existing standards in 30 CFR 56.5001, 56.5005, 57.5001, and 57.5005 indefinitely while the court-ordered stay is in effect. If you work in metal or nonmetal mining, the current respirable crystalline silica and respiratory protection rules remain in place until the court lifts the stay.
