Preliminary Results in Korean Hot-Rolled Steel Duty Review Released

Summary

The U.S. Department of Commerce found that some Korean steel makers got unfair government help during 2023, so they’re reviewing taxes on those hot-rolled steel products. Cash Deposit Rule After Final Results

Commerce intends to instruct U.S. Customs and Border Protection to collect cash deposits of estimated countervailing duties on shipments of the subject merchandise entered, or withdrawn from warehouse for consumption, on or after the date of publication of the final results of this review. If the final rates are zero or de minimis, no cash deposit will be required for shipments entered on or after that publication date.

Preliminary Subsidy Rates for Korean Mills

Commerce preliminarily found countervailable subsidies for hot-rolled steel from Korea for the period January 1, 2023 through December 31, 2023. Commerce preliminarily assigned subsidy rates of 1.28% for Hyundai Steel Company and 3.71% for POSCO, as part of the April 10, 2026 notice.

Rescission for 13 Companies, Assessment at Deposit Rate

Commerce is rescinding this administrative review, in part, for 13 listed companies because the record shows no entries of subject merchandise during January 1, 2023 through December 31, 2023. For those companies, Commerce will instruct CBP to assess countervailing duties on all appropriate entries at a rate equal to the cash deposit required at the time of entry during that period; rescission instructions will be issued no earlier than 35 days after this notice.

Final Assessment Timing and Instructions

For companies remaining under review, Commerce will instruct CBP to assess countervailing duties on appropriate entries at the subsidy rates calculated in the final results. Commerce intends to issue assessment instructions no earlier than 35 days after publication of the final results, and final results are expected within 120 days of publication of these preliminary results unless the deadline is extended.
