Emergency Medicaid Attestation Added

The revised Medicaid State Plan template requires states to attest they will provide emergency coverage for treatment of emergency medical conditions ("emergency Medicaid"). Section 71109 of the Working Families Tax Cut (WFTC) legislation says emergency Medicaid expenditures are excepted from federal financial participation limits.

Federal Funding Limited To Certain Noncitizens

Section 71109 limits federal financial participation (FFP) for full Medicaid coverage to U.S. citizens or nationals and only three groups of noncitizens: lawful permanent residents (LPRs), Cuban/Haitian entrants, and COFA (Compact of Free Association) migrants. Individuals outside those categories would not be FFP-eligible for full Medicaid under that limit, with limited exceptions.

Coverage During Verification (ROP) Required

The revised template adds a required attestation that a State will provide coverage during a reasonable opportunity period (ROP) while U.S. citizenship, nationality, or satisfactory immigration status is being verified. The template also lists State options related to extending the ROP for noncitizens.

CHIPRA 214 Option for Lawfully Residing People

The revised template includes a State option to provide medical assistance to lawfully residing children and pregnant women (the "CHIPRA 214 option"). If a State chooses this option, lawfully residing children and pregnant women can be covered under that authority.
