ECOA: No Disparate-Impact Claims
The Bureau's final rule says the Equal Credit Opportunity Act (ECOA) does not allow disparate-impact ("effects test") claims. This change applies to discrimination claims under ECOA for protected characteristics such as race, color, religion, national origin, sex, marital status, age, or income from public assistance, and it takes effect July 21, 2026.
New Limits and Conditions for SPCPs
The final rule adds prohibitions and conditions for Special Purpose Credit Programs (SPCPs) offered or participated in by for-profit organizations, and clarifies requirements for written plans and program administration. These changes to how SPCPs qualify under Regulation B take effect July 21, 2026.
Narrower Rule on Discouraging Applicants
The rule narrows and clarifies what counts as a creditor 'discouraging' applicants. It says the prohibition covers statements of intent to discriminate in violation of ECOA and is not triggered just by negative consumer impressions; it also clarifies that encouraging statements to one group are not automatically prohibited as to others. These clarifications take effect July 21, 2026.
