Federal OSHA Returns on Federal Properties

If you work for a private employer on land, property, or space owned or leased by the federal government in Puerto Rico where federal employees are regularly present, federal OSHA now has enforcement authority instead of the Puerto Rico State Plan. This change is effective April 24, 2026 and transfers coverage from PR OSHA to federal OSHA for those workplaces.

Marine Construction Moves to Federal Oversight

If you do marine construction work for a private employer in Puerto Rico, federal OSHA now has enforcement authority over those jobs starting April 24, 2026. Coverage for marine construction performed by private-sector employees was transferred from the Puerto Rico State Plan to federal OSHA.

Clarified Coverage on Military Installations

Federal OSHA will exercise enforcement authority over private-sector employers within the secured borders of U.S. military installations in Puerto Rico where access is controlled, while PR OSHA retains authority over state and local government employers on those installations. This clarification is included in the new Operational Status Agreement effective April 24, 2026.

USPS and Mail-Operation Contractors Under Federal OSHA

Federal OSHA will continue to have enforcement responsibility over federal government employers, including the United States Postal Service (USPS), and over contractors and contractor-operated facilities engaged in USPS mail operations in Puerto Rico. This is part of the 2025 Operational Status Agreement effective April 24, 2026.

Cabin Crew Working Conditions Covered Federally

Federal OSHA covers all working conditions of aircraft cabin crewmembers onboard aircraft in operation in Puerto Rico, under the new OSA effective April 24, 2026. This provision places onboard aircraft working conditions for cabin crew under federal enforcement authority.

Federal Inspections Can Cover Whole Projects

The 2025 OSA adds a provision that federal OSHA can inspect and take enforcement action at an entire project or facility where both federal and PR OSHA authorities exist, and federal enforcement may begin immediately upon agreement. This change became effective April 24, 2026 and is intended for administrative practicability.

Federal Role on Refused Entry and Whistleblowers

Federal OSHA will exercise enforcement authority in situations where PR OSHA is refused entry or cannot obtain a warrant, or is temporarily unable to exercise enforcement authority. Federal OSHA will also continue enforcement of complaints filed with federal OSHA under the OSH Act whistleblower provision (Section 11(c)). These authorities continue under the OSA effective April 24, 2026.
