EPA 'Not Likely' Green Light

If you submitted a PMN, MCAN, or SNUN and EPA made a finding between February 1, 2026 and February 28, 2026 that the new chemical or significant new use is “not likely to present an unreasonable risk” to health or the environment, you may commence manufacture or processing for that chemical or use even if part of the EPA review period remains. This statement is published under TSCA section 5(a)(3)(C) and TSCA section 5(g).

90-Day Notice Requirement Remains

Anyone who plans to manufacture (including import) a new chemical substance for a non-exempt commercial purpose, or any manufacturer/processor wishing to begin a use designated as a significant new use, must submit a notice to EPA at least 90 days before starting manufacture or the significant new use. This 90-day submission requirement is stated in the notice and remains the timing rule for TSCA section 5(a) notices.

Modified Yeast (J-25-0013) Cleared

EPA lists case number J-25-0013 — “Modified yeast, with chromosomal modifications to improve fermentation characteristics” (generic name) — as a submission for which EPA made a finding under TSCA section 5(a)(3)(C) that it is not likely to present an unreasonable risk. The submitter may proceed with manufacture or processing for that case consistent with the EPA finding made during February 1–28, 2026.
