Continued DS-117 Path to Keep Residency
If you are a lawful permanent resident or conditional resident who left the United States and could not return within the validity period of your reentry document due to circumstances beyond your control, Form DS-117 will continue to be collected to determine if you can be classified as a returning resident. The form is used to decide eligibility under INA section 101(a)(27)(A) and section 203(b)(4) and is required to obtain or retain the benefit of returning resident status.
Filing Burden: 30 Minutes, No Fee
Completing Form DS-117 takes about 30 minutes on average and the Department estimates 4,200 respondents per year with a total burden of 2,100 hours. You can submit the form electronically by email or print and submit it in person at a U.S. embassy or consulate abroad, and there is no additional fee noted for filing the form.
