Published Date: 5/12/2026

Notice

Summary

The U.S. International Trade Commission is taking a second look at a decision that found certain ink cartridges and parts violated Epson’s patents. They’re asking for written opinions on what should happen next, including possible fixes, public impact, and money matters. This affects companies importing or selling these ink cartridges and could lead to changes in what’s allowed or blocked soon.

Possible U.S. Import Ban for Ink Cartridges

The U.S. International Trade Commission may order exclusion of certain ink cartridges and components from entry into the United States or issue cease and desist orders that would require respondents to stop importing and selling those products. The ALJ's recommended determination (Order No. 16, issued March 24, 2026) sought a general exclusion order and cease and desist orders against Mountain Peak and Straightouttaink; the Commission voted to review the ID in part on May 8, 2026.

Bonding Requirement During Presidential Review

If the Commission orders a remedy, the U.S. Trade Representative has 60 days to act during which accused articles may still enter the United States under bond in an amount the Commission prescribes. The ALJ recommended a bond of 100 percent of the entered value during the period of Presidential review; the Commission has asked for submissions on the appropriate bond amount.
