Protecting Veteran Access to Telemedicine Services Act of 2025
Sponsored By: Representative Womack
Passed House
Summary
Authorizes telemedicine delivery of controlled substances to eligible veterans. It would let qualified VA clinicians, and supervised trainees, deliver, distribute, or dispense certain prescription controlled drugs by telehealth without a prior in-person exam when providers meet state licensure and federal drug-law conditions. The VA Secretary must issue implementing regulations and guidance while preserving all provider obligations under the Controlled Substances Act and the Federal Food, Drug, and Cosmetic Act.

- Veterans: Eligible VA patients could receive certain prescription controlled medications by telemedicine, reducing the need for an in-person visit when the prescription has a legitimate medical purpose.
- VA clinicians and trainees: VA-employed clinicians with an active, full, and unrestricted state license could prescribe and dispense these drugs by telehealth, and trainees can do so under clinical supervision and Secretary-set qualification rules.
- Oversight and limits: The authority is conditioned on compliance with the Controlled Substances Act and related federal drug laws and requires the Secretary to create rules and quality standards for implementation.

Easier telehealth controlled medications for veterans
If enacted, eligible VA patients could get prescription controlled medications by telemedicine without an in‑person exam. A covered VA provider would need an active, full, unrestricted state license, act in the usual course of practice, and prescribe only for a legitimate medical purpose. VA would issue rules and processes, and providers would still have to follow the federal Controlled Substances Act. Only VA employees authorized to provide care (not contractors) would count as covered providers; trainees could participate only under clinical supervision. This could reduce travel and improve access for veterans who use telehealth.
