Summary
Prohibits counting benefits when determining whether someone is an employee under Federal law. The bill would require that employee-status tests ignore any "benefit" tied to work. It defines benefit to cover protections or perks workers keep after they stop working and typical full-time offerings such as workers' compensation, skills training, paid leave, disability and health coverage, retirement savings, and short-term savings. Contributions toward those benefits by an employer, the worker, or both would also be excluded from consideration.

If enacted, the bill would ban Federal authorities from counting whether someone provides a "benefit" when deciding employee status. Contributions toward these benefits, by the employer, the worker, or both, are also covered. The rule would start on the date of enactment. If enacted, employers could find it easier to label workers as contractors. Some workers could lose access to employee-only protections and benefit-linked supports.
