Extends temporary telehealth recertification rules for Medicare hospice through December 31, 2027. It would also require hospice recertification claims done by telehealth to include a telehealth modifier or code starting January 1, 2026.

  • Families and hospice patients: Would keep telehealth as an option for hospice eligibility checks and recertifications through Dec. 31, 2027, so remote recertifications remain possible.
  • Hospice providers and clinicians: Telehealth recertifications on or after Jan. 1, 2026 would be limited in cases where the area has a Medicare hospice enrollment moratorium of at least 6 months, the hospice is under enhanced oversight, or the clinician is not enrolled in Medicare enrollment rules and has not opted out.
  • Medicare billing and program administration: Hospice claims for telehealth recertifications would need one or more Secretary-specified modifiers or codes starting Jan. 1, 2026 to denote the telehealth modality.

Medicare hospice telehealth extended with limits

If enacted, Medicare hospice patients would keep telehealth for recertification visits through December 31, 2027, instead of ending March 31, 2025. Starting January 1, 2026, this option would not apply if the area has a Medicare hospice enrollment moratorium for at least six months. It would also not apply if the hospice is under enhanced Medicare oversight, or if the hospice doctor or nurse practitioner is not enrolled with Medicare and has not opted out. Starting January 1, 2026, hospice claims for telehealth recertifications would need a code or modifier showing the visit was by telehealth, using codes set by Medicare.
