Right to sue over SSA data leaks
If enacted, you would be able to sue for unauthorized access or disclosure of your Social Security data. You could get at least $5,000 per act or your actual losses, whichever is larger. If the conduct was willful or grossly negligent, a court could add punitive damages. You could also recover court costs and reasonable lawyer fees; fees against the United States would be allowed only if you win. You must file within two years after you discover the disclosure. SSA would notify you if someone is criminally charged or if an agency proposes discipline tied to your case. Good‑faith mistakes and disclosures you requested would not be liable. This would apply to violations after the bill takes effect.
Ban appointees from SSA data systems
This bill would bar political appointees and special government employees from accessing SSA beneficiary data systems. Covered systems would include Numident, the Master Beneficiary Record, SSI records, disability files, earnings records, and data in the Enterprise Data Warehouse. This would apply to violations after enactment and is meant to better protect your Social Security information.
Faster breach probes and public reports
SSA’s Inspector General would have to investigate each illegal disclosure or unauthorized access and could group related incidents. The IG would report to Congress within 30 days of learning of a violation, with details, risk findings, and any stopped benefit payments. GAO would study how these privacy rules work and send monthly updates starting within one month, plus a final report within one year. This oversight would help surface problems quickly and push for fixes.
Keep current SSA privacy rules
This bill would lock in the SSA privacy regulations that are in place on January 19, 2025 (20 CFR part 401). Those rules would keep controlling who can view or share your Social Security records, even if other parts of this bill might change things. This aims to preserve today’s privacy protections.
