Delphi Retirees Pension Restoration Act

Summary

Guarantee full vested pension benefits for certain Delphi and affiliated plans. This bill would require the Pension Benefit Guaranty Corporation (PBGC) to recalculate guaranteed monthly benefits for eligible participants and beneficiaries and pay any shortfalls as lump sums with interest.

Restore full Delphi pensions with back pay

If enacted, retirees and beneficiaries in six named Delphi plans would have their guaranteed benefit set to their full vested amount, without the usual caps or phase-in limits. The federal pension insurer (PBGC) would recalculate past payments and raise future monthly checks. PBGC would also pay a lump sum within 180 days for past underpayments, plus 6% yearly interest. You must be eligible for payments and not covered by the 1999 GM top‑up deals to qualify.

Spread taxes on pension make-up payment

If enacted, most lump-sum make-up payments would be taxed over three years by default. Each year, you would include one‑third of the payment in income, unless you elect out under IRS rules. If you die before three years end, the rest would be taxed in your year of death. A surviving spouse with a PBGC survivor benefit could elect to report those remaining amounts instead.

How the pension agency would fund this

If enacted, the pension agency would pay these higher benefits and its costs from the ERISA fund’s unobligated balance. It would not change prior asset allocations or recoveries for the covered plans, and normal practices would continue unless this bill says otherwise. A technical fix would clarify that these benefits count under the ERISA fund rules.
