  • Foreign buyers would be held to their home country’s rules for buying U.S. agricultural land, with special rules for dual citizens and companies. For companies, the home country is the one with the most restrictive laws where at least 5 percent of owners are citizens.
  • Sellers must report any sale of agricultural land to the Secretary of Agriculture. The Secretary must also notify the State senator and the House member for the district where the land sits.
  • A U.S. Land Protection Task Force chaired by the Secretary of Agriculture and including CFIUS, the Department of Justice national security division, and the State Department would identify violations. The Task Force would report to Congress within 1 year and every 6 months after that with data on land sales by state and type, average cost, title history, and whether land lies within 100 miles of a military installation.

New task force to track foreign land deals

This bill would create a U.S. Land Protection Task Force led by the Agriculture Secretary. It would include CFIUS, DOJ’s National Security Division, and the Secretary of State. The Task Force would find violations and report to Congress within 1 year, then every 6 months. Reports would show what share of farm land was sold to foreign buyers by land type, the States of sale, average purchase cost, title history for each sale, and whether any land is within 100 miles of a military base.

Sellers must report foreign land sales

If enacted, sellers of agricultural land would have a new duty. You would need to report a sale to a foreign purchaser to the Secretary of Agriculture. The Secretary would then notify the U.S. Senators from the State and the U.S. Representative for the district where the land is located.

Tighter limits on foreign farm land buys

This bill would tighten rules for foreign buyers of U.S. farm land. A foreign buyer would have to follow the same limits that a U.S. citizen would face when buying farm land in the buyer’s home country. State land limits would still apply too. The bill defines who counts as a foreign buyer, including AFIDA “foreign persons” and U.S. citizens who also hold another country’s citizenship. It would set how to pick a buyer’s home country, including a “most restrictive” rule for people with more than one citizenship and for companies with at least 5% ties to a country.
