Faster federal checks and roll updates
If enacted, states would have to set up programs to find and remove noncitizens from federal voter rolls and to mark when DHS verifies a voter. Federal agencies would have to respond to state verification requests, including batched requests, within 24 hours and could not charge fees. The Election Assistance Commission would have 10 days to send guidance on implementation. Changes to voter registration forms would not be subject to the Paperwork Reduction Act.
New proof rules for voter registration
If enacted, you would need documentary proof of U.S. citizenship to register to vote in any Federal election. States could not accept or process a registration without that proof. DMVs and other registration agencies would ask about citizenship, record and verify your documents, and only give registration forms after proof is shown. If you lack listed documents, the State must let you sign an affidavit and submit other evidence for an official to decide.
Stronger penalties and private lawsuits
If enacted, the bill would expand criminal penalties for federal employees or others who help a noncitizen register or vote, and for registering someone who does not show documentary proof. The bill would also create an explicit private right of action against officials who register applicants without the required proof.
New photo ID rules for federal voting
If enacted, you would have to show an eligible photo ID to vote in Federal elections. In-person voting would require a physical ID at the polling place. Absentee voters would need to include a copy of the eligible photo ID with the ballot request and with the returned ballot. IDs must include a photo, a front notation of U.S. citizenship (or be paired with another document that shows citizenship), and a state ID number or the last four digits of your Social Security number. Jurisdictions that send voter lists to DHS SAVE quarterly and mark verified voters may be excused from the front-of-ID citizenship note for verified voters.
