The Gold Star Family Education Parity Act would end Chapter 35 Survivors' and Dependents' Educational Assistance and transition those beneficiaries into the Post-9/11 GI Bill under Chapter 33. - Families: Surviving spouses and children who get Chapter 35 assistance would instead receive Chapter 33 Post-9/11 educational benefits in the same manner as if they had elected under section 3327.
- Rules and limits: The transition would operate notwithstanding the crediting-of-service rule in section 3322(h)(1) but would remain subject to the limits in section 3327(d)(2).
- Statutory change: The bill adds a new Subchapter VIII with section 3571 to Chapter 35 and updates the chapter table of sections to record the termination.

Survivor education moves to Post-9/11 benefits
If enacted, Chapter 35 education help for survivors and dependents would end on August 1, 2029. People who lose Chapter 35 because of this would be able to use Post-9/11 (Chapter 33) benefits instead. You would be treated as if you had chosen the Post-9/11 option, and some usual limits would still apply. One existing restriction on how service is credited would be waived for this switch. This only applies to those who lose Chapter 35 due to the program ending.
