Designating certain border-area airports as ports of entry. This bill would direct the President to designate qualifying airports and to end the user fee requirement under section 236 of the Trade and Tariff Act of 1984 for those airports.

  • Airport operators and local governments: Primary airports within 30 miles of the northern or southern land border that are formally linked to a nearby land border crossing or seaport and that meet four statutory criteria could be designated a port of entry and would no longer face the Trade and Tariff Act user fee.

Port of entry status and fee relief for border airports

If enacted, the President would have to name certain border airports as official ports of entry. To qualify, an airport must be a primary airport under 49 U.S.C. 47102 and be within 30 miles of the northern or southern land border. The airport must also be tied by contract or ordinance to a land border crossing or a seaport within 30 miles. Through that tie, it must meet CBP’s numeric standards for a port of entry (T.D. 82-37, 86-14, 87-65, or updates). The bill would also end the user fee under 19 U.S.C. 58b for these airports, which could lower costs for airports and carriers and help travelers with on-site customs and immigration.
