Summary

Strengthens local capacity to detect and stop elder financial fraud and modern scams. The GUARD Act would let State, local, and Tribal law enforcement use specified federal grant funds to investigate elder financial fraud, pig butchering, and other general financial fraud, and it would enable federal help with blockchain tracing and related tools.

  • Seniors and vulnerable adults: Would fund investigations and victim assistance focused on elder financial fraud, pig butchering, and scams to improve response and case work.
  • State, local, and Tribal law enforcement: Would authorize using eligible Department of Justice and related grant funds to hire analysts, agents, and experts. It would fund training on complex and transnational financial investigations, emerging technologies, and purchase of software and technical tools.
  • Financial institutions and nonbank firms: Would support tabletop exercises, improved data collection, and designate a financial sector liaison to boost information sharing with banks and other firms.
  • Federal oversight and coordination: Would require a Treasury and Financial Crimes Enforcement Network joint report within 1 year and another joint report within 2 years to Congress with estimates on scam incidence, losses, overseas actor involvement, enforcement actions, and agency spending. Public comments from consumers and industry would inform one report.

If enacted, State, local, and Tribal law enforcement could use listed DOJ grants to investigate elder, crypto (“pig butchering”), and other financial fraud. They could hire staff, buy software, improve data and reporting, and train on victim help and cross-agency work. Training could include blockchain intelligence tied to the February 2024 Critical and Emerging Technology List and transnational cases. Agencies could run exercises with banks, name a financial liaison, and would have to report within one year on use and results. Federal law enforcement could also give technical help and training on blockchain tracing tools.

Defines scams and eligible grant funds

If enacted, the bill would set clear definitions for “elder financial fraud,” “general financial fraud,” “scam,” and “pig butchering.” It would clarify that seniors and adults with disabilities are covered victims for these crimes. It would name which DOJ grant programs count as “eligible Federal grant funds.” “State” would include the 50 states, D.C., and U.S. territories.
