- Families and dependents: Eligible dependents could receive the service member's Post-9/11 GI Bill entitlement as of the separation date. A child could only begin using transferred benefits after the transferor reaches six years of service.
- Service members: Individuals who were separated between August 24, 2021 and January 10, 2023 solely for refusing a COVID-19 vaccine would be eligible to transfer their entitlement, but only during a 90-day window after enactment.
- Department of Veterans Affairs and scope: The transfer authority would be added as a new subsection to 38 U.S.C. §3319 and would operate notwithstanding other law. The provision does not create new funding or appropriation mechanisms.

One-time GI Bill transfer for vaccine-related separations
If enacted, this would let certain former service members transfer their Post-9/11 GI Bill benefits to an eligible dependent. You must have left the Armed Forces between August 24, 2021 and January 10, 2023 solely for refusing a COVID-19 vaccine. You would have 90 days from enactment to make the transfer, and only the benefit you had on your separation date could be moved. If you transfer to a child, the child could not use the benefit until you complete at least six years of service. This would apply even if normal transfer rules would otherwise block it.
