Summary

Makes noncitizens who incite or join assaults during civil unrest removable and permanently barred from reentry. The bill would create a new deportation ground for people who incite violence or physically take part in assaults, riots, or willful destruction of public property during civil disturbances.

  • People who were unlawfully present, were DACA recipients, or were lawful permanent residents at the time of the offense would be deportable if convicted of or admitting to incitement or acts such as assault or battery against law enforcement, assault on members of the U.S. Armed Forces, or vandalism of government-owned property.
  • Anyone removed under this new ground would be permanently inadmissible and ineligible for relief like asylum, cancellation of removal, adjustment of status, withholding of removal, or deferred action. The bill also bars future DACA benefits for those removed under this rule.
  • The bill would require these rules to be applied without discretion during declared national, major disaster, or state and local emergencies, allow the Department of Homeland Security to use expedited removal for these offenses, and mandate detention while removal is pending.

Deportation for noncitizens in riots

If enacted, this would make some noncitizens deportable for inciting or taking part in violent civil unrest. It would cover convictions or admissions under federal, state, or local law, including assault on police, assault on U.S. service members, or vandalism of government property. It would apply if the person was unlawfully present, was a DACA recipient, or was a lawful permanent resident at the time. People covered would be ineligible for asylum, cancellation of removal, adjustment, withholding, or deferred action, and could face mandatory detention. Anyone removed under this ground would be permanently barred from returning and could not get DACA later. It would apply to offenses on or after enactment.

Faster removal during emergencies

If enacted, during certain emergencies these rules would be applied without discretion. Covered emergencies include a national emergency, a major disaster, or a state or local emergency declared by a governor or mayor where the offense happened. During those periods, DHS could use expedited removal for the new riot-related offenses. Noncitizens covered could face faster removal while the emergency lasts.
