Ties federal education funding to enforcement of Executive Order 14201 on "biological fairness" in women's sports. The bill would require annual written certifications from K–12 school districts and colleges that they follow Executive Order 14201 and would let the Education Department claw back unobligated funds or block future federal funding for noncompliance.

  • Local school districts and schools: LEAs would have to certify by August 15 each year that each school complies with Executive Order 14201. State education agencies must report by September 15 any LEAs that fail to file or face complaints, and the Secretary may demand return of unobligated ESEA funds or bar an agency from receiving more funds until it complies.
  • Colleges and universities: Institutions would need to certify by July 1 each year that they comply with Executive Order 14201 to keep federal financial assistance or to participate in federally backed student loan programs. A new program participation requirement is added to section 487(a) of the Higher Education Act.
  • Students and families: Students at schools or colleges that do not certify or are found noncompliant could see their institution lose federal grants or become ineligible for federal student aid programs while the school remains out of compliance.

College aid and loans tied to sports policy

This bill would make colleges ineligible for federal funds and federal student loan programs unless they certify by July 1 each year that they follow Executive Order 14201 as it exists at enactment. If the Secretary finds a violation, the college could be required to return unused funds and would be ineligible for federal funds and programs until it complies. The bill would also add this duty to the college’s federal program participation agreement. Students at noncompliant schools could lose access to federal aid or loans.

K-12 school funds tied to sports policy

This bill would tie K-12 federal education funds to following Executive Order 14201 on women’s sports, as it exists at enactment. Each school district would need to certify in writing by August 15 each year that every school complies and will stay in compliance through the next August 15. States would have to report by September 15 which districts did not certify or have complaints. If the Secretary finds a violation or a State fails to report, the Secretary could require return of unused funds (including subgrants) and make the district or State ineligible for funds until it complies. Families could see school services cut if funds are withheld.
