Automatic donor alerts and record access
If enacted, hospitals that take Medicare or Medicaid would need to set up automatic alerts to the local organ procurement agency. Starting 2 years after enactment, when a patient is deceased or death is imminent under federal protocol, the agency would get an electronic alert and remote access to the patient’s health records. This would be subject to exemptions in the bill for cyberattacks, disasters, or serious hardship.
Exemptions and guidance for hospitals
If enacted, HHS would give a 1-year automatic exemption when a hospital is hit by a cybersecurity attack or is in a disaster area. HHS could grant up to 3 years for significant hardship, like limited rural internet, and extend exemptions if needed. HHS would report to Congress on the number of exemptions and reasons, starting within 2 years and then every year. Within 1 year, HHS would issue guidance to states on how to explain the alerts and record access to donors and families. Within 1 year, HHS would also issue guidance to hospitals, organ agencies, and health record companies on how to comply, using lessons learned. The bill defines cybersecurity attack broadly to include threats to data or hospital systems.
