- Principal Deputy and Deputy Inspectors General must have served at least 180 of the prior 365 days to be eligible to serve as acting Inspector General.
- For IGs that require Presidential appointment with Senate confirmation, the first assistant would serve as acting IG; if that role is vacant, unavailable, or declines, the court-based process would apply.
- A randomly selected court of appeals judge would appoint an acting IG from at least two candidates recommended by a three-IG committee convened by the Council of the Inspectors General on Integrity and Efficiency, with 14-day deadlines for recommendations and appointment.

Independent process to fill inspector general vacancies
If enacted, this would change how vacant inspector general jobs are filled. The first assistant would serve as acting inspector general unless that role is vacant, unavailable, or declines. If so, a randomly selected appeals court judge would appoint a temporary inspector general. A committee of three inspectors general would recommend at least two candidates within 14 days, and the judge would appoint within 14 days of getting the list. Deputies would need at least 180 of the past 365 days in their roles to qualify. These rules would apply even if another vacancy law conflicts. It would also make a specific part of H.R. 7326, passed by the House on December 3, 2024, take effect first.
