Temporary status and protections for farm workers
This bill would open a three-year window starting at enactment. Certain noncitizen farm workers could apply for a temporary work status. You would need at least two years of U.S. farm work between Jan 1, 2021 and your departure or removal, and you must not have unlawfully received public benefits. Approved workers could be admitted for up to three years and may renew for another three years. Some immigration bars and removal rules would not apply to covered workers during the window, including if you left or were removed before enactment and seek to return after 30 days to do farm work. Employers hiring covered workers would also get protection from certain hiring penalties during this period.
New $2,500 fees for workers and employers
If enacted, both the applicant and the petitioning employer would have to pay a fee to use this program. The fee would be at least $2,500 per person, and could be higher if the Labor Department sets a higher amount. This fee rule would apply only during the three-year covered period after enactment.
