Protecting Health Care and Lowering Costs Act of 2025

Sponsored By: Representative Gray

Introduced

Summary

Overhaul of the Premium Tax Credit is the bill's main change. The bill would also repeal the health-related subtitle of recent reconciliation and swap the current affordability test for a new income-based sliding scale that changes required premium shares across income tiers.

Show full summary
  • Families and households: The bill would remove the 400% of poverty cap on eligibility, potentially making tax credits available to people with incomes above 400% of the federal poverty line.
  • Low- and moderate-income enrollees: People up to 150% of the poverty line would have a 0% required premium share while required shares would rise in steps up to 8.5% for higher incomes under the new sliding scale.
  • Health law and rules: The bill would repeal Subtitle B of title VII of the cited reconciliation law and treat any law or regulation referenced there as if those subtitle changes had not been enacted, restoring the prior health framework.

The new premium rules would apply to taxable years beginning after December 31, 2025.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Sliding tax credit for premiums

If enacted, this would change how the Premium Tax Credit is set. Your required share of the benchmark premium would use a sliding scale based on your income. Up to 150% of the poverty line: 0%. 150%–200%: up to 2.0%. 200%–250%: up to 4.0%. 250%–300%: up to 6.0%. 300%–400%: up to 8.5%. At 400% and above: 8.5%. It would also remove the 400% income cap in the eligibility rule, so some people above 400% could get help at 8.5%. These rules would apply for tax years starting after December 31, 2025.

Roll back prior health policy changes

If enacted, the bill would repeal a set of health rules from an earlier law (Public Law 119-21, Subtitle B of title VII). Laws and rules named in that subtitle would be applied as if that subtitle never passed. This would take effect upon enactment. The impact would vary, since restoring earlier rules could help some groups and limit others.
