Summary
Continuity of FAA funding from the Airport and Airway Trust Fund during appropriations lapses. This bill would let the FAA keep programs running by drawing amounts from the Airport and Airway Trust Fund that match what was provided for the preceding fiscal year when an appropriation or continuing resolution is not in place.

- FAA operations and programs: It would make Trust Fund amounts available to the Administrator for Operations, Facilities and Equipment, Research, Engineering and Development, and Grants-in-Aid for Airports at rates no higher than the prior fiscal year.
- Airport grants and loans: Grants, direct loan costs, and loan guarantees that were funded in the prior year would be eligible for Trust Fund support during the lapse and later charged to the applicable appropriation when a regular bill or continuing resolution becomes law.
- Timing and limits: The authority would start on the first day of a lapse and end when a regular appropriation or a continuing resolution becomes law or 30 days after the lapse begins. It would not apply where another law already provides continuing funding or where a program is specifically barred from continuing.

FAA could keep operating during shutdowns
If Congress misses FAA funding, the FAA could use money already in the Airport and Airway Trust Fund. It would cover Operations; Facilities and Equipment; Research, Engineering and Development; and airport grants. Spending would be limited to the prior year’s rate (or the prior year’s continuing resolution). The backstop would start on day one of a lapse and end when new funding or a continuing resolution is signed, or after 30 days, whichever comes first. It would follow last year’s terms, continue across year‑end if needed, and not apply if another law funds or blocks these programs.
Technical update to aviation trust fund
If enacted, the bill would add this Act to the tax code rules for the Airport and Airway Trust Fund. This would guide Treasury and fund managers on using the Fund under the new backstop. It would take effect at enactment and would not change tax rates or provide new money.
