American Family Act
Sponsored By: Representative DeLauro
Introduced
Summary
This bill creates monthly child tax credit payments that replace the annual Child Tax Credit mechanism and add a separate credit for other dependents. It sets fixed monthly amounts, a monthly advance payment system, rules for presumptive eligibility, and enforcement for improper claims.
Show full summary
- Families and parents: Parents get monthly payments of $300 per child age 6 and older, higher monthly rates for younger children, and a $2,400 payment for a child in their birth month.
- Other dependents and income: A new $500 nonrefundable credit for other dependents is added and phases out for higher earners, with thresholds that vary up to about $400,000 depending on filing status.
- Administration and safeguards: The IRS will deliver monthly advance payments, use presumptive eligibility and a submission portal, require child and taxpayer TINs, permit limited data sharing with other government entities, and can disallow claims for fraud with penalties including a 120-month bar for fraud and a 24-month bar for reckless or intentional disregard.

Bill Overview
Analyzed Economic Effects
4 provisions identified: 2 benefits, 1 costs, 1 mixed.
Monthly child credit for families
If passed, families could get a monthly child tax credit. It would pay $300 per child age 6+, $360 for under 6, and $2,400 for a newborn under 1 month. The credit would start to phase down above about $150,000 (joint), $112,500 (single or head of household), and $75,000 (married filing separately), and you could elect to use a prior year for this test. To get refundable monthly amounts, you must live in the U.S. or Puerto Rico more than half the month and list each child’s name and tax ID. The IRS could send advance monthly payments if you opt in and renew each year; any difference would be settled on your tax return. This would replace the old annual Child Tax Credit starting with tax years after 2024, and amounts would adjust for inflation after 2025.
New $500 credit for other dependents
If passed, you could get a $500 nonrefundable credit for each eligible dependent who is not a monthly child credit recipient. It would phase down by $50 for each $1,000 (or part) your income is over the limits: $400,000 for joint, $200,000 for married filing separately, and $300,000 for others. If a dependent turns 18 during the year, the $500 would be prorated by months. This would start for tax years after 2024.
Long bans for fraudulent child credit claims
If enacted, a final fraud finding on a child credit claim would block credits and monthly payments for 120 months (10 years). A final finding of reckless or intentional disregard would block them for 24 months (2 years). These bans would apply to tax years after 2024.
IRS rules to run monthly child payments
If passed, the tax code would be updated so systems point to the new monthly child credit and payment rules. The IRS would be allowed to share limited tax data to run payments and resolve disputes, like names and tax IDs of children, income amounts, and where a child lived. These changes would help decide who gets payments but would not change benefit amounts by themselves.
