Would require the Attorney General to publish a public, annual list of states and local governments that permit release pending trial on personal recognizance or upon execution of an unsecured appearance bond for certain serious offenses.

Show full summary
  • States and local governments would be publicly named if they allow cashless pretrial release for covered offenses such as violent or sexual crimes (for example, murder, rape, robbery, burglary, assault) and public-disorder crimes (for example, looting, vandalism, rioting, fleeing a law enforcement officer).
  • Residents, victims, and the public would get a single federal source to see which jurisdictions permit release without secured bail for those listed offenses.
  • The Attorney General would be directed to publish the initial list within one year and then update it annually, and the reporting requirement does not establish new funding, penalties, or enforcement mechanisms.

Annual list of cashless bail jurisdictions

This bill would require the Attorney General to publish a public list, not later than one year after enactment and annually thereafter. The list would identify every State and unit of local government that allows release pending trial on personal recognizance or by an unsecured appearance bond for people charged with a "covered offense." The bill defines "covered offense" as crimes the Attorney General finds pose a clear threat to public safety, including violent or sexual offenses (for example, murder, rape, robbery, burglary, assault) and crimes that promote public disorder (for example, looting, vandalism, rioting, fleeing from an officer). The list would be updated every year. This section does not provide new funding or create new penalties or enforcement mechanisms.
