New consent and chaperone rights for Medicare patients
Starting January 1, 2026, Medicare-participating providers would need new consent and chaperone policies. Adult patients (or a surrogate if state law allows) would get written information on their rights: to be told their health status, help plan care, give informed consent before services, and ask for a chaperone during sensitive exams. Providers would train staff on chaperone duties and what counts as a sensitive procedure. A sensitive procedure would include exams or surgery involving the genitals, breasts, or rectal areas, and any procedure you consider sensitive. A chaperone would be trained staff who witness the exam, help keep a safe setting, and report sexual abuse to a supervisor.
