Body and dash cameras for immigration officers

If enacted, DHS would have 180 days to require body cameras for officers and dashboard cameras for vehicles, with recording on by default. Footage would be kept one year, then deleted unless a use of force or a complaint is involved, which would trigger at least 3 years of retention. Subjects and other listed parties could ask DHS to keep footage at least 3 years if it may help or clear them. Footage tied to investigations or lawsuits could not be discarded until those end. Requesters could inspect footage, and DHS would provide a public redacted version.

DHS database and regular reports to Congress

If enacted, DHS would keep a searchable database of training, certifications, and required incident reports, and hold supervisors accountable for improper approvals. Members of Congress for the area or on relevant committees could see unredacted records, and the public would get a redacted version. DHS would report every 6 months (starting within 3 months) on non‑deadly force uses, assaults on officers, cases without identification (classified), and how often face coverings are used. DOJ would also report every 6 months on people impersonating immigration officers and DOJ’s actions.

Tighter force and ID rules for immigration officers

If enacted, non-deadly force could be used only when no safe, effective alternative exists, and it must be proportional. Officers would have to try to de‑escalate, protect bystanders, and consider age, injury, disability, and size. They would have a duty to step in and report excessive force. Masks or face coverings would need written approval for limited reasons. Officers would generally need visible agency ID, and uniforms could not use titles like “Police” that cause misidentification.

Limits on immigration crowd-control gear

If enacted, officers would be barred from using flash bangs, rubber bullets, pepper balls, and tear gas, with narrow exceptions. An exception could apply during an arrest of a person entering or trying to enter the U.S., or when a true public safety or national security threat exists and a supervisor approves a tactical plan. Only trained, certified staff could use this gear. Operations could keep a trained backup team for safety, but lawful protest alone could not justify deploying them.

Annual training and tougher discipline for officers

If enacted, all immigration officers would get yearly training on use‑of‑force rules, de‑escalation, First and Fourth Amendment protections, bans on race‑based targeting, duties to intervene, and giving medical aid. DHS’s civil rights office and DOJ’s inspector general would investigate and, where allowed, discipline officers who break these rules.

Notice to local police and cooperation limits

If enacted, federal immigration teams would have to notify local law enforcement before operations in that area. The bill would let DHS define who counts as covered personnel and what qualifies as a national security or public safety threat. It would not give officers new deadly‑force powers, and it would not force state or local police to help with federal immigration enforcement.
