New Medicare pay rules for AI services
This bill would make Medicare create a new outpatient payment group for FDA-cleared AI and machine-learning services starting January 1, 2026. Manufacturers would have to send cost data like invoice and subscription prices, staff, and overhead in a form the Secretary sets. Medicare could not remove a service from that new payment group until enough claims exist to reassign it and it has been paid there for at least five years. The Secretary would also update eligibility so adjunctive or concurrent AI services can qualify.
Medicare outpatient SaaS payment rule
This bill would require HHS to apply the hospital outpatient payment policy for software-as-a-service (SaaS) that was finalized on November 23, 2022 to services provided on or after January 1, 2023. If enacted, hospitals and software vendors would be paid under that rule for applicable outpatient software services. This could change billing, contracting, and Medicare payments for those services.
