More homes count as manufactured
If enacted, federal law would define manufactured homes as built with or without a permanent chassis. HUD would work with other federal agencies so these homes are treated the same across programs. This could help more buyers get financing, insurance, and other protections.
States must certify equal treatment
If enacted, each State would have to certify parity for homes without a permanent chassis within 1 year of enactment (2 years if the legislature meets biennially). States would then recertify each year on a date HUD sets. HUD would post which States are current. HUD could provide model templates and technical help to States to make these filings.
No sales of chassis-less homes if state late
If enacted, a “covered manufactured home” would be one built after enactment that federal law treats as a manufactured home but the State does not because it lacks a permanent chassis. If a State misses the initial (1 year, or 2 years for biennial legislatures) or annual certification deadlines, the State must prohibit making, installing, or selling these homes. In States where HUD handles installation, both the State and HUD would enforce the ban.
New standards and labels for chassis-less homes
If enacted, HUD would set construction rules for manufactured homes built without a permanent chassis after consulting a consensus committee. These homes would need a special HUD label, a data plate as in 24 CFR 3280.5, and a clear note on the invoice. Buyers could see what they are purchasing, while makers and dealers would face new compliance steps.
Federal preemption stays the same
If enacted, the bill would not change existing federal preemption under the manufactured housing law. It would keep the current balance between federal standards and State or local rules.
