Summary

Creates an exemption that would let certain local general sales tax revenues be used for airport-related purposes without the usual federal written assurances on revenue use. • Local governments: Local governments that had a generally applicable sales tax before December 9, 2014 and that are not sponsors of a public airport could use those tax revenues for airport-related spending under the bill's conditions.
  • Large hub airports: Airports defined as large hubs (more than 35 million enplanements in 2021) would gain access to an additional local revenue source for airport projects.
  • Federal program assurances: The Federal Aviation Administration and Department of Transportation written assurances on revenue use would not apply to these specific local general sales tax revenues when the bill's three criteria are met.

Local sales tax use for airports

This bill would let some local governments use general local sales tax revenue for airport-related purposes without the usual federal written revenue-use assurances. To qualify, the local government must have had a generally applicable sales tax that did not exclude aviation fuel in effect before December 9, 2014. The local government also must not be a sponsor of a public airport. A large hub airport with more than 35,000,000 enplanements in calendar year 2021 must be located inside the local jurisdiction. The bill would not create new federal funding, an entitlement, or a sunset date.
