New vehicle owner data rights
This bill would require manufacturers to give each vehicle owner secure, real-time access to that vehicle’s data at no extra cost beyond the vehicle price. Access must work through the vehicle port or wirelessly (if the vehicle has wireless), let owners delete user data, and follow voluntary cybersecurity standards like ISO/SAE 24134. The bill would say who counts as an owner, including designees, beneficial owners, and lessees with leases of 180 days or more. The Federal Trade Commission could enforce these owner-access rules as unfair or deceptive acts. The bill would also preempt state or local laws that conflict, and it would preserve a limited confidential business information protection for manufacturers except where owner-access rules require disclosure.
New limits on vehicle data sales
This bill would bar manufacturers or fleet owners from selling covered vehicle data unless they give owners or drivers a clear, conspicuous chance to opt out. Fleet opt-out rules would not apply to data from a commercial or government vehicle driven in the course of employment, except if driver behavior data is sold for harmful profiling outside work. The bill would treat a fleet owner as someone controlling five or more vehicles or a lessee with leases of 180 days or more. It would also prohibit knowingly selling vehicle data to North Korea, China, Russia, Iran, or Venezuela.
