If enacted, HHS would set up a partnership program to keep U.S.-made personal protective equipment (PPE) available for public health emergencies. The Secretary would have one year to finish rules and a contracting process to guarantee supplies and manufacturing capacity. Companies would need to be based in the continental United States, majority U.S.-owned, have verified supply agreements, and meet a production schedule: 50% domestic in 2026, 75% in 2027, and 100% in 2028 for items sold to the federal government. HHS would keep an approved PPE list; products must meet CDC and OSHA quality rules, have 510(k) clearance, and be priced using fair-market benchmarks. The bill would also bar federal, state, and local agencies using federal funds from buying infection-prevention clothing or equipment made outside the United States, though narrow legal exceptions could apply with a written justification.
